Apparently **Cumulative Update 5 for SQL Server 2008 R2 SP1** has a **fix** for this bug ...
It's been known for ages @@identity should be avoided and scope_identity() is more stable.

The shortcut is, open SQL Server help file. On the top of right side, there is an option for url. Type the site url there and press enter. The page will get opened without opening any browser......

Indeed, don't promote functions on columns in where clauses.
Use foldable expressions in stead as **RamiReddy D** showed....
